These Terms and Conditions govern your access to and use of the WaziBot platform. By creating an account or using WaziBot, you agree to be bound by these terms.
1. The Service
WaziBot provides a software-as-a-service platform ("the Service") that enables businesses to automate WhatsApp customer interactions, manage orders, process payments, and communicate with customers through an AI-powered assistant.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
2. Accounts
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access to your account
- Each business may have one primary account; sharing accounts between multiple businesses is not permitted
- You must be at least 18 years old to create an account
3. Acceptable Use
You agree to use WaziBot only for lawful purposes and in accordance with these Terms. You may use WaziBot to:
- Automate legitimate customer service conversations via WhatsApp
- Process orders and manage inventory for your business
- Send broadcast messages to customers who have opted in to receive communications from your business
- Process payments through supported payment methods
4. Prohibited Activities
⚠ Violations of this section may result in immediate account termination without refund.
You must NOT use WaziBot to:
- Send spam — unsolicited messages to people who have not engaged with your business
- Phishing or fraud — impersonate other businesses, collect credentials deceptively, or engage in fraudulent transactions
- Harassment — send threatening, abusive, or harassing messages to any person
- Illegal content — distribute illegal, harmful, or offensive content
- Platform abuse — attempt to bypass rate limits, exploit API vulnerabilities, or reverse-engineer the system
- Data harvesting — collect or scrape customer data without consent
- Circumvent WhatsApp policies — violate Meta's WhatsApp Business Policy or Developer Terms
- Reselling without permission — resell, sublicense, or white-label the platform without written agreement
5. WhatsApp and Meta Compliance
Your use of WaziBot is subject to compliance with:
You are responsible for ensuring that your use of WaziBot complies with Meta's policies. Violations may result in your WhatsApp number being suspended by Meta, for which WaziBot accepts no liability.
6. AI Limitations
WaziBot uses an AI assistant to handle customer conversations. You acknowledge that:
- AI responses may occasionally be inaccurate, incomplete, or inappropriate
- You are responsible for monitoring and reviewing AI-generated responses
- The Human Handoff feature allows you to take control of conversations at any time
- WaziBot is not liable for business losses caused by AI response errors
- AI responses do not constitute professional advice (legal, medical, financial, etc.)
7. Payments
- WaziBot facilitates payment instructions but does not directly process card transactions
- Payment processing by third-party providers (PayPal, EcoCash) is governed by their respective terms
- You are responsible for ensuring correct payment configuration and order fulfilment
- WaziBot is not liable for failed, disputed, or fraudulent transactions processed through your business
8. Data and Privacy
Your use of WaziBot is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
As a business using WaziBot, you are a data controller for your customers' personal data. You must:
- Have a lawful basis for processing customer data
- Inform your customers that their messages are processed by an AI system
- Respond to customer data access/deletion requests as required by applicable law
9. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or third-party outages (Meta, Supabase, Render) may cause temporary unavailability. We are not liable for losses caused by service downtime.
10. Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms or our Acceptable Use Policy
- Engage in spam, fraud, or abuse
- Violate Meta's WhatsApp policies
- Remain inactive for more than 12 months (with prior notice)
You may delete your account at any time. Upon deletion, your data is removed within 30 days.
11. Limitation of Liability
To the maximum extent permitted by applicable law, WaziBot and its operators shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of revenue or business opportunities
- Data loss caused by third-party infrastructure failures
- AI response errors or miscommunications
- Losses arising from account suspension by Meta or payment processors
12. Indemnification
You agree to indemnify and hold WaziBot harmless from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights or applicable laws.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the platform. Continued use after changes are posted constitutes acceptance.
14. Governing Law
These Terms are governed by applicable law. Disputes will be resolved in the jurisdiction where the platform operator is based.
